Oneida Affiliate Program

As you have probably heard, the state of California recently passed nexus tax law which requires online retailers to collect tax should they receive customers referred from in-state affiliate web sites. This law went into effect on Friday, July 1st 2011. We are happy to let you know that Oneida will not be removing any of its California affiliates and will continue to support all California affiliates who are joined to the program. We understand this may have been a concern for you and wanted to let you know Oneida's stance on these recent happenings.

Thank you always for your support of the Oneida affiliate program and we look forward to continuing our relationship with you and your team throughout the year!

Please feel free to reach out to your Oneida Affiliate manager with any questions!

Backcountry Affiliate Program

With the impending passing of the California Budget which includes an Affiliate Nexus provision we have begun the process of removing all publishers located in the State of California. From what we understand the Governor needs to sign the bill by July 1st and that when he does it will become effective immediately, if the Governor does not sign the bill all publishers will be reinstated to our program.

If you have any questions please feel free to reach out,

Dennis Kirk Affiliates,

I would like to clarify the previous email regarding the removal of California publishers. While this email is being sent to our entire affiliate base, this change will only affect publishers who reside in the state of California, I apologize for any confusion. If you do not reside in California, please continuing promoting Dennis Kirk as you were as these changes do not affect our current relationship. We appreciate your understanding and please feel free to reach out with any questions.

The Clymb Affiliate Program

With all the new state tax laws that have passed in recent months I think it's important to let you know about our affiliate tax law policy.

Unlike many online retailers TheClymb.com will not be removing affiliates that reside in states where these laws have passed. Instead, we've worked closely with AvantLink on a solution. Below is the policy from our terms and conditions for the affiliate program, please contact me with questions.

Affiliate Tax Law Policy

Due to state sales tax nexus laws, publishers from the following list of states will not be paid a commission on sales referred to residents of the same state - Arkansas, California, Connecticut, Illinois, New York, North Carolina, Rhode Island.

For example, if you reside in New York and refer a sale to TheClymb from a NY resident, we're unable to pay you for that transaction. If you refer a sale to a customer from any other state you will receive a commission.

Please constant me if you have questions regarding our policy.

Sincerely,

Brian Boyd

Clickinks Supports California Affiliates

As you have more than likely heard, effective July 1, 2011, California has passed Nexus laws that which require retailers to collect sales tax should they use affiliates based in California.

I am happy to tell you this WILL NOT affect the Clickinks affiliates. Clickinks will continue to support affiliates in California as it has with other states.

HOWEVER, though this is indeed great news. There is a chance for relief for those who have been terminated. Amazon Filed for Referendum in California. Which means is that there is a chance to block this law and force it to go to vote next year.

Take a moment to go to the Performance Marketing Association site and check for updates.

Here is the official Request for Title and Summary for Proposed Referendum to ABx128

Clickinks cannot give you any legal advice. Please consult a trusted Tax Attorney. If you have any non-legal questions, I am always available.

Best regards,
